The Court of Appeal in Makurdi, Benue State, yesterday affirmed the decision of the lower court that sacked the member of the Benue State House of Assembly representing Oju 2 state constituency, Mr. Matthew Ire, of the opposition Peoples Democratic Party (PDP).
The Federal High Court in Makurdi presided over by Justice Binta Nyako had voided the legibility of the election of Ire (PDP) and had ordered that the petitioner, Agi Micheal Adigwu (PDP), who contested the PDP House of Assembly primaries on November 29, 2014 be immediately sworn in by the Assembly.
However, lawyer to Ire, Mr. Andrew Wombo, had appealed against the judgement of the lower court and prayed the appellate court to stay execution of the ruling, even as INEC quickly issued a certificate of return to Agi, the petitioner.
At the Court of Appeal yesterday, the presiding judge, Justice Ifeoma Jumbo, upheld the earlier decision of the lower court, saying Agi (PDP) was the authentic winner of the party primaries and should be installed by the state assembly.
